What is Florida sales & use tax?

Florida imposes a 6% state sales tax on most retail sales, leases and taxable services, plus a county discretionary sales surtax: 1% in Miami-Dade County, giving a combined rate of 7%. Businesses with a Florida presence must register with the Department of Revenue, collect tax, and file Form DR-15 monthly, quarterly or annually depending on volume. Out-of-state sellers trigger economic nexus once Florida remote sales exceed $100,000 in the prior calendar year. Kingsley Accounting Group handles registration, filing, nexus review and voluntary disclosure for businesses that have fallen behind.

Sound familiar?

These are the situations that bring people to this service most often.

You sell into multiple states and have no idea where you have crossed a threshold.
You have been collecting the wrong rate because the surtax cap was never applied.
You never registered, have been selling for two years, and are hoping nobody notices.
Your marketplace collects on some sales and not others, and reconciling is a nightmare.

What’s included

Every engagement covers the following as standard. Nothing here is an upsell.

  • Discretionary surtax application, including the $5,000 cap most people miss
  • Monthly, quarterly or annual DR-15 filing on the schedule the DOR assigns you

Frequently asked questions

The combined rate is 7%: Florida's 6% state sales tax plus Miami-Dade County's 1% discretionary sales surtax. Importantly, the county surtax applies only to the first $5,000 of a single item of tangible personal property, so on larger transactions the effective rate is lower. This cap is one of the most commonly missed rules in Florida.

Florida's economic nexus threshold is $100,000 in taxable remote sales into Florida during the previous calendar year. Once you cross it you must register and begin collecting. Unlike many states there is no separate transaction-count trigger.

Florida offers a voluntary disclosure program. Coming forward proactively typically limits the lookback period and waives penalties, though interest still applies. Waiting until the Department contacts you removes those protections entirely: this is a situation where acting early genuinely pays.

Most professional services are not, but Florida taxes a specific list that includes commercial real property rentals, nonresidential cleaning, commercial pest control, detective and security services, and certain repair and fabrication work. Whether you are on that list is worth confirming rather than assuming.
